The U.S. Supreme Court heard oral arguments as to whether President Trump has the constitutional authority to rescind the DACA program instituted by former President Obama via Executive Order.
During arguments, Justice Sotomayor opined, the Trump administration hadn’t taken sufficient account of the personal, economic, and social disruption that might result should DACA be terminated.
This is a policy argument, not constitutional analysis. The only issue the court should be considering is whether a sitting President has the constitutional authority to rescind a previous President’s executive order. Period.
